English summary: At the moment there is a disparity in German constitutional law between the written law and the law which is actually applied. A number of unwritten constitutional rules of law are being used in daily practice although their dogmatic principles have not yet been clarified. Constitutional law experts ignore this state of affairs to a great extent. According to the system they stand for, these legal rules should not exist. Heinrich Amadeus Wolff examines the discrepancy between theory (charter of the constitution) and practice (current constitutional law). He discusses the difference between constitutional law, jus naturale and legislation and shows clearly how the interpretation of the law differs from the written law. He concludes by attempting to combine reality and theory. German description: Gegenwartig besteht im Verfassungsrecht eine Kluft zwischen dem geschriebenen Recht und dem Recht, das tatsachlich zur Anwendung kommt. Die Praxis arbeitet mit einer Reihe von ungeschriebenen Verfassungsrechtssatzen, obwohl die dogmatischen Grundlagen ungeklart sind. Die Staatsrechtswissenschaft ignoriert weitgehend diese Sachlage. Nach dem von ihr uberwiegend vertretenen System durfte es diese Rechtssatze nicht geben. Heinrich Amadeus Wolff untersucht den Unterschied zwischen Theorie (Verfassungsurkunde) und Praxis (gegenwartiges Verfassungsrecht). Dazu erortert er den Unterschied zwischen Verfassungsrecht, Naturrecht und dem einfachen Recht und macht deutlich, wie Rechtsinterpretationen vom geschriebenen Recht abweichen. Abschliessend versucht er, Realitat und Theorie zusammenzufuhren.
